Fifth Circuit Hands Texas Major Win on Rio Grande River Buoy Lawsuit

(Bethany Blankley, The Center Square) One year after Texas installed marine barriers in the Rio Grande River near Eagle Pass, Texas, the U.S. Court of Appeals for the Fifth Circuit ruled Texas has the legal right to do so.

It also reversed a district court’s preliminary injunction and remanded the case back to the court “with instructions to vacate the preliminary injunction and for further proceedings consistent with this opinion.”

Circuit Judge Don Willett wrote the majority opinion.

Willett made similar arguments as Gov. Greg Abbott had, saying, “the district court clearly erred in finding that the United States will likely prove that the barrier is in a navigable stretch of the Rio Grande. We cannot square the district court’s findings and conclusions with over centuries worth of precedent, which on a fair and faithful reading renders inapplicable or unpersuasive the evidence on which the district court relies.”

Abbott lauded the ruling, saying, “The Federal Court of Appeals for the Fifth Circuit just ruled that Texas can KEEP these buoys in the water securing our border. Biden tried to remove them. I fought to keep them in the water. That is exactly where they will stay. JUSTICE!!!!”

Three judges issued separate opinions concurring with Willett: Chief Judge Priscilla Richman, Andrew Oldham and James Cho.

Circuit Judge James Ho partially concurred and partially dissented, agreeing that the preliminary injunction “must be reversed. But I get to that place through a different path,” he said, adding that he would have instructed the district court to dismiss the case for lack of jurisdiction.

He argued Texas’ right to install the buoys was a constitutional one: a sovereign state has the right to protect its own border. He made similar arguments to those of 55 Texas judges who declared Texas was being invaded.

“A sovereign isn’t a sovereign if it can’t defend itself against invasion,” Ho wrote. “Presidents throughout history have vigorously defended their right to protect the Nation. And the States did not forfeit this sovereign prerogative when they joined the Union. Indeed, the Constitution is even more explicit when it comes to the States. Presidents routinely insist that their power to repel invasion is implied by certain clauses. But Article I, section 10 is explicit that States have the right to ‘engage in War’ if ‘actually invaded,’ ‘without the Consent of Congress.’”

Seven dissenting judges argued the federal government was likely to succeed on the merits of its case, disagreeing with the majority who said it wasn’t.

Circuit Judge Stephen Higginson wrote one dissent. Circuit Judge Dana Douglas wrote another.

The ruling comes after several twists and turns in the case and as extensive misreporting about it continues. Many claimed, and continue to claim, that Texas was ordered to remove the buoys altogether when the district court only ordered they be moved closer to Texas’ riverbank, The Center Square first reported.

Multiple claims were made that the buoys caused migrants to drown, had razors or knives built in and were cutting people. The Center Square debunked them in an exclusive interview with Border Czar Mike Banks, who demonstrated how the buoys work.

“The buoys deter migrants from crossing the river and putting themselves in danger. They’re saving lives, they’re not taking lives,” he told The Center Square.

After Abbott installed the buoys in July 2023, the Biden administration filed a civil complaint, demanding that he remove them. Abbott said he wasn’t removing them and told President Joe Biden he had violated his constitutional oath, was continuing to violate the U.S. Constitution and had broken his compact with the states. Texas has a right to defend its border when the federal government won’t, he argued.

The administration argued Texas installing the buoys violated Section 10 of the Rivers and Harbors Act, which Abbott refuted, saying the statute’s definitions “does not describe any action by the State of Texas.” Willett and the majority agreed.

Within two months of the lawsuit being filed, last September, a federal judge sided with the Biden administration but only ordered Texas to move back, not remove the buoys. “The Court is directing that the buoy barrier be moved from the main waters of the Rio Grande River to the riverbank, rather than removal entirely from the river, so that the barrier does not impede or impair in any way navigation by airboats or other shallow draft craft along the Rio Grande River,” he said.

Within 24 hours of that ruling, the Fifth Circuit unanimously issued a stay, effectively enabling the buoys to remain in place.

Three months later, last December, a Fifth Circuit three-judge panel reversed the stay, siding with the district court. It issued a preliminary injunction requiring Texas to “cease work on the barrier and shift it to the Texas riverbank.” Willett was the sole dissent.

Texas then appealed, asking the full court to hear its case, which it did in January of this year. In Tuesday’s ruling, Willett also ordered that the court’s panel decision be dissolved.

It remains unclear if the Biden administration will appeal to the U.S. Supreme Court since the majority ruled it is unlikely to win on the merits of the case.

SCOOP: FBI Releases File on Moms for Liberty; Group Member Reacts

(Ken Silva, Headline USA) The FBI has released internal records on Moms for Liberty, the non-profit activist group that opposes the public-school system’s attempts to indoctrinate students to favor genital mutilations, mask mandates, racial profiling and other un-American ideals.

However, the internal records are unrelated to the Justice Department’s targeting of Moms for Liberty and other protesting parents—a scandal from October 2021, when Attorney General Merrick Garland issued a memo directing the FBI to divert counterterrorism resources towards tracking alleged threats at school board meetings.

Instead, the records detail threats Moms for Liberty members apparently received in 2022. A December 2022 FBI memo details the “concerning comments directed towards Moms for Liberty organization.”

“On Wednesday, November 30, 2022, [REDACTED] Moms for Liberty, [REDACTED] contacted Task Force Officer [REDACTED] after receiving a concerning message through her website,” the FBI memo stated.

“The message was submitted by an individual identified as [REDACTED] … The message stated [REDACTED].”

According to the records, the person who sent threats to Moms for Liberty did so in three separate messages. However, an Assistant U.S. Attorney in Tampa declined to prosecute the person. The reason for the declination of prosecution is redacted.

Along with threats, Moms for Liberty members were apparently worried about being doxed. A February 2023 internal FBI record shows that the bureau spoke with someone from the group about an opposition organization called “Stop Moms for Liberty,” which was apparently disseminating the private info of certain members.

“Stop Moms for Liberty was sharing a list of names belonging to Moms for Liberty members located in [REDACTED] County and [REDACTED] County, Pennsylvania. This information included member employment data amongst other sensitive details,” stated a Feb. 24, 2023, FBI report.

“Moms for Liberty members … expressed concern to [REDACTED] this may lead to future targeting of their members for harassment or potential violence.”

It’s unclear how the matter was resolved. Stop Moms for Liberty did not respond to an email seeking comment about the records.

Brooke Weiss, the head of a Moms for Liberty chapter in North Carolina, told Headline USA that receiving threats has been par for the course for many members.

“I recently had to file a police report … because I was being doxed, harassed, and threatened. Somehow, they got my personal phone number and started using a burner app to target me in extremely antisemitic ways. They would send me grossly antisemitic messages along with a screenshot of a Google map with my address on it. At first, I didn’t think it was related to Moms for Liberty, but then it became very apparent that it was,” Weiss said.

“We have always taken threats very seriously. Many of us have been spit on and had things thrown at us. Some of us have had our homes and cars damaged. The people that attack us are unhinged, and it is very apparent that many of them are mentally unstable,” she said.

“So, we have always taken safety precautions and are regularly counseled on how to keep ourselves safe. We always have paid police details at larger events now.”

New Secret Service Boss Barks at Hawley, Cruz over Damning Questions

(Luis Cornelio, Headline USA) Secret Service Acting Director Ronald Rowe appeared defiant and confrontational when pressed by Republican senators about security failures during the nearly successful assassination attempt on President Donald Trump.

Rowe, who assumed the role after Kimberly Cheatle’s resignation, became agitated on a Tuesday hearing before the Senate Judiciary and Homeland Security committees when Sens. Josh Hawley, R-Mo., and Ted Cruz, R-Texas, pressed him with pointed questions about the on-site supervisors and whether any requests for increased security had been denied.

Hawley specifically asked Rowe to name the agents who failed to confirm that the building from which the failed assassin, Thomas Matthew Crooks, fired shots at Trump was secured.

In response, Rowe claimed he did not want to single out any specific individual. “Sir, this could have been our Texas School Book Depository. I’ve lost sleep over that for the last 17 days, just like you have,” Rowe said, referencing the building from which Lee Harvey Oswald fatally shot President John F. Kennedy in 1963.

“I’ll tell you senator that I will not rush to judgment that people will be held accountable—and I will do so with integrity and not to rush to judgment and people unfairly persecuted,” he added.

Hawley, stunned by Rowe’s defiant response, retorted, “Unfairly prosecuted? You’ve got people who are dead!”

Like Hawley, Cruz pressed Rowe on reported denied requests for increased security from the Trump team in the two years leading up to the assassination attempt. Secret Service spokesperson Anthony Guglielmi falsely refuted reports of such requests.

Cruz asked Rowe if he had approved Guglielmi’s false statement. When Rowe failed to identify the individual responsible for approving the statement, Cruz suggested that leftist politics might have influenced the Secret Service.

“Did the same person deny the Trump request that also denied the [Robert F. Kennedy Jr.] request? That’s a yes or no,” Cruz pressed.

Rowe, appearing agitated, said, “Senator, that is not a ‘yes or no’ question.” Cruz replied, “Does the buck stop anywhere?”

Rowe again did not answer. When Cruz pressed him about whether any Secret Service agents were transferred from the Trump detail to a nearby event hosted by First Lady Jill Biden, Rowe dodged the question, his tone growing angrier.

Kamala Staffers Spill Tea on Toxic Work Environment: Don’t Look Her in the Eye

(Luis Cornelio, Headline USA) Vice President Kamala Harris, during her tenure as California attorney general, subjected her staff to cruel and denigrating acts.  This included demanding that interns avoid eye contact with her and stand up when she entered the office.

This disturbing behavior was unveiled by columnist Terry McAteer in a 2019 piece for The Union, a California-based newspaper. His son, Gregory McAteer, had approved the piece before its publication.

The Washington Free Beacon and RedState first reported on the 2019 column on Monday, followed by Fox News’s Jesse Watters on Tuesday.

“Gregory had an eye-opening experience in Kamala Harris’ office that none of us expected,” McAteer wrote in the op-ed. “For his sake, the month could not pass quickly enough.”

Harris, who served as attorney general from 2011 until 2017, reportedly mistreated her staff using curse words, including frequent “F-bombs.”

McAteer added that the staff was “in complete fear of her” as she used “her profanity throughout the day.”

In a show of superiority, Harris would force her staffers to stand up and salute her with a “Good morning General” greeting whenever she entered the attorney general’s office.

According to the column, Harris never once introduced herself to McAteer’s son, and other staffers were too “intimidated” to introduce him to her.

“The only acknowledgment was a form letter of ‘thanks’ signed by Harris given to him on his last day of service,” the author continued.

Disturbingly, the intern recalled being ordered to never look at Harris’s eyes “as that privilege was only allowed to senior staff members.”

McAteer’s accounts of Harris’s behavior align with troubling reports of the treatment of staff during her tenure as vice president, a position she assumed after serving as a California senator from 2017 to 2021.

According to reports, a staggering 92 percent of Harris’s aides left her office in the first three years of her vice presidency.

“Chaos reigns on the vice president’s staff. Our auditors at OpenTheBooks quantified an extraordinarily high 91.5-percent staff turnover rate,” said Adam Andrzejewski, the founder of Open The Books. “Furthermore, the turnover chaos isn’t getting better. In the trailing 12-month period, 24 staffers left — that’s almost half the employees.”

Trump Releases New Ad about ‘Dangerously Liberal’ Kamala Harris

(Dmytro “Henry” Aleksandrov, Headline USA) The Trump campaign released a new ad in which it criticized Kamala Harris, calling her “failed, weak, and dangerously liberal.”

The ad’s focus was the disastrous immigration policy of the Biden-Harris administration. In the video, the Trump campaign accused Harris of failing to address the flow of hundreds of thousands of illegal aliens into the country, even though Joe Biden assigned her with the task of dealing with the invasion of illegals that the Biden-Harris administration itself started.

“This is America’s border czar, and she’s failed us. Under Harris, over 10 million [people are] illegally here. A quarter of a million Americans [died] from fentanyl, brutal migrant crimes and ISIS now here,” the ad stated.

The Trump campaign also showed an infamous clip from Harris’s interview with NBC’s Lester Holt in which the anchor asked her whether she had any plans to visit the southern border.

“You haven’t been to the border,” Holt said during the June 2021 interview just five months after Biden stepped into the White House.

Instead of responding to the statement, Harris said that she’s never “been to Europe” as well, implying that these two things are related.

However, the mass media was informed that criticizing Harris was now forbidden, which resulted in the propaganda outlets denying that they were previously calling Harris the “border czar,” a title they had given her back in 2021.

The Daily Wire reported that earlier this year, immigration surged to become the top issue on voters’ minds, even putting inflation down to second place.

After Donald Trump left office, the Biden-Harris administration got rid of his border policies, instead implementing its globalist ones, which resulted in around 12 million illegals entering the United States illegally.

Additionally, immigration authorities said that there have been more than 9.5 million migrant encounters as well as about 1.7 million illegal alien getaways.

On July 30, 2024, RNC Research also released an extensive list of things Harris did and said that highlighted her radical leftist ideology once again.

Dems Get Pushback over ‘Weird’ Echo-Chamber Attack on Vance

(Luis Cornelio, Headline USA) Conservative personalities and Republican officials are dunking on the leftist media for their uniform attacks on JD Vance, President Donald Trump’s running mate, using the term “weird.”

The term “weird” was first introduced by Kamala Harris’s presidential campaign as a response to Vance’s defense of pro-family values. Tom Elliott, the founder of media company Gabrien, produced a video exposing the media’s frequent use of this term to describe Vance:

However, the label faced swift pushback as some conservatives on Twitter reminded their followers of mounting instances where Democratic Party figures have engaged in behaviors rightfully deemed as “weird.”

Twice-failed presidential candidate Hillary Clinton wrote, “If Republican leaders don’t enjoy being called weird, creepy, and controlling, they could try not being weird, creepy, and controlling.” In response, comedian Dave Smith said, “I thought your husband being accused of rape by six women was weird,” referring to former President Bill Clinton.

In response to the “JD Vance is weird” trend, Popular Twitter page Libs of TikTok posted a photo of Sam Brinton — the disgraced former Biden official who pleaded guilty to suitcase theft — alongside three individuals in pup hoods and leather harnesses.

Disgraced former Sen. Al Franken, D-Minn., also echoed the “weird” narrative by labeling Trump’s laughter as “cruel” and “derisive.” Fraken’s post was met with the infamous photos from 2006 showing him attempting to grope radio host Leeann Tweeded.

Conservative pundit Greg Price shared a side-by-side comparison of Vance’s family photos and an image of Harris with a drag queen wearing dramatic makeup, a voluminous wig and a colorful dress.

“The left wants you to believe that one of these people is ‘weird’ is that the other one is completely normal,” Price captioned the photo.

George Takei, a leftist actor and gay activist, jumped on the anti-Trump and Vance wagon by calling them “too weird for America.”

In response, Takei’s tweet was met with flashback photos from his 2017 Howard Stern show appearance, where he celebrated his 80th birthday by enjoying himself inappropriately interacting with guests, including holding host Jason Ellis’s genitals.

The desperate campaign to label Vance as “weird” comes as Harris tries to rebrand herself before the American electorate, despite her disastrous record as vice president.

The media, as shown by the Gabrien compilation, appears eager to portray Harris favorably, prompting critics to link such a positive portrayal as the product of the alleged CIA-run and Cold War-era Operation Mockingbird.

The pro-Robert F. Kennedy Jr. super PAC, American Values, claimed on Monday that “Operation Mockingbird never ended. It simply went underground, adapting to the times, and has now wormed its way into the heart of our so-called ‘free’ media.”

Pro-Hamas Protesters Chant ‘Hail Hitler,’ Do Nazi Salute to Taunt Israeli Olympic Team

(Dmytro “Henry” Aleksandrov, Headline USA) Jew-hating demonstrators with Palestinian flags and a sign that read “Genocide Olympics” reportedly chanted “Heil Hitler!” and did the Nazi salute when the Israeli national anthem was played before the Israeli men’s soccer team played Paraguay at the Paris Olympics on July 27, 2024, night.

The Daily Wire reported that, at the Israeli men’s team’s opening game against Mali, anti-Semitic protesters booed during the playing of the Israeli national anthem.

On July 26, 2024, Israeli team coach Guy Luzon predicted that there would be demonstrations against Jews at the game.

“Bring on the loudest protests. They will make us try harder,” he said during a press conference.

It was also reported that, on July 28, 2024, Nurali Emomali, a judo competitor from Tajikistan, refused to shake hands with his Israeli opponent, Baruch Shmailov, after the match, instead deciding to yell, “Allahu Akbar.”

The Times of Israel reported that Israel’s Olympic athletes received death threats in the middle of July of this year.

“The People’s Defense Organization announces that it intends to harm any Israeli presence at the Olympics … the Jewish lobby that controls the French Parliament won’t decide anything anymore … the fate of the Zionists will be like the fate of the Palestinians in Gaza if the Zionists continue to threaten everyone … Therefore, you’re not invited to Paris 2024,” the organization wrote in its message.

The organization continued to threaten Jews from Israel by remembering how eight Palestinian terrorists from the group Black September, an affiliate of the Palestinian Liberation Organization, invaded the Olympic Village, murdering two Israeli athletes while holding nine others hostage in 1972.

“If you come, take into account that we intend to repeat the events of Munich 1972 … You will be awaiting attack at every moment — in the airport, the hotel and the streets which belong only to us. Even a wave of arrests against our organization won’t stop us from seeing our plan through. Prepare for the intifada!” the terrorists wrote.

The news source also reported that some Israeli athletes, such as the Opening Ceremony flagbearer Peter Paltchik and swimmer Meiron Amir Cheruti, received invitations to their own funerals.

Iran Got $16B from Illicit Oil Sales Thanks to Biden Admin; Now Seeks to Return the Favor

(Dmytro “Henry” Aleksandrov, Headline USA) It was reported that Iran got nearly $16 billion in profits from its illicit oil trade over just the past several months because both Joe Biden and Kamala Harris never bothered to enforce sanctions against the state.

Mohammad Rezvanifar, the head of Iran’s Customs Administration, said on July 29, 2024, that Tehran exported a total of “$15.7 billion worth of oil in the first four months in the Iranian calendar” year, which lasted from March 21, 2024, to July 22, 2024.

The Washington Free Beacon reported that the country’s state-controlled press said that most of this crude oil was offloaded in China, Turkey, the United Arab Emirates, Germany and India.

Iran’s illicit oil trade, which is heavily sanctioned by the United States and other Western nations, became incredibly successful under the Biden-Harris administration, topping around $90 billion as of March of this year. These billions helped the tyrannical regime not only to survive the economic uncertainty but also to fund its network of terror proxies, including Hamas and Hezbollah.

“Policymakers must connect the dots: Iran’s unprecedented oil sales have occurred because, for nearly four years, the Biden-Harris administration stopped enforcing U.S. sanctions. Tehran and its proxies have used this revenue to attack Israel, U.S. troops and global shipping,” Andrea Stricker, a research fellow at the Foundation for Defense of Democracies think tank, said.

The Wall Street Journal reported that the Islamic Republic of Iran is working to sabotage Donald Trump’s presidential campaign over fears that he would put a stop to the current prosperity of the world’s leading state sponsor of terrorism.

An official with the Office of the Director of National Intelligence said during a press briefing that U.S. intelligence has “observed Tehran working to influence the presidential election” because they don’t want Trump to become the leader of the United States once again.

Just a few weeks ago, Iran had planned to act as a “chaos agent” in the election, with the plan only recently being changed to target and damage Trump’s campaign.

The news source reported that Iran is meddling in American elections by using “vast webs of online personas and propaganda mills to spread disinformation” on social media where they are conducting campaigns to show that Trump is supposedly losing the 2024 election.

Among the tactics of the online campaigns are attempts to directly engage with U.S. citizens and influence their thoughts about the election. The Journal reported that the Islamic Revolutionary Guard Corps, a designated terrorist organization that answers to Supreme Leader Ayatollah Ali Khamenei, is believed to be behind the election interference.

Venezuelans Riot over Maduro’s Stolen Election that Used Same Equipment U.S. Does

(Jacob Bruns, Headline USA) Venzuelan President Nicolás Maduro reportedly arrested and jailed the opposition leader Tuesday following heavily disputed elections that led to a mass public uprising against the socialist despot a eerily similar to that in the United States under President Joe Biden.

Maduro claimed victory against opponent Edmundo González—at least according to a Sunday night statement from Venezuela’s National Electoral Council—after voting machines malfunctioned in favor of Venezuela’s established government in the heated election, Legal Insurrection reported.

According to the report, Maduro received 51% of the vote to win reelection to González’s 44%, despite González leading Maduro by 25% in exit polls.

Notably, the notoriously corrupt nation used Smartmatic-powered vote counting machines, among which are Dominion voting machines—the very same that led some to question the widespread irregularities and lack of security in America’s 2020 election.

The Smartmatic system has been used historically in Venezuela. In a prior election in the nation, the company admitted five years later that it officially tallied one million more votes than were officially cast.

As Smartmatic systems continue to show up in irregular elections, people have naturally begun to grow skeptical of the software.

Outrage on Tuesday led to protests across the nation.

“It’s going to fall. It’s going to fall. This government is going to fall!” some protesters shouted as they walked.

Protesters also tore down a statue of infamous dictator Hugo Chavez, who was Maduro’s predecessor.

Meanwhile, in the U.S., even President Joe Biden—who won in 2020 perhaps largely to Smartmatic voting systems—was questioning the outcome of Venezuela’s recent election.

Joined by Brazilian President Luiz Inacio Lula da Silva, Biden said on Tuesday that the Venezuelan government must publish the vote tallies of Sunday’s election.

“The two leaders agreed on the need for immediate release of full, transparent, and detailed voting data,” the White House said in a statement.

As Biden worried about the validity of foreign elections, news broke Sunday that Fulton County—which also relied on Dominion systems—had violated the State of Georgia’s election laws during the 2020 election by failing to verify signatures and double-scanning some ballots.

DHS: Venezuelan Gang Given ‘Green Light’ to Kill American Police

(Elias Irizarry, Headline USA) The chief intelligence officer of Homeland Security Investigations sounded the alarm on Tuesday that thousands of members of Venezuela’s deadliest gang have been permitted by their kingpins to commit acts of violence against U.S. police officers.

According to a memo distributed to DHS officers in Chicago, the gang known as Tren de Aragua, was given the “green light” by leaders to fire at law enforcement.

“Credible human sources from Colorado provided information on TdA [Tren de Aragua] giving a ‘green light’ to fire on or attack law enforcement,” the memo said. “As you may know, we have a TdA presence here in Chicago, so please be vigilant.”

Colorado’s capital city, Denver, holds the largest amount of illegal immigrants per capita in the entire country.

“We have zero access to other nations’ criminal databases and with this administration’s uselessness in deterring these criminals, they will keep entering undetected,” a source with the Border Patrol told the New York Post.

In June, a 19-year-old illegal immigrant from Venezuela, Bernardo Raul Castro Mata, was arrested for shooting two officers with the New York Police Department.

Mata told law enforcement that he was recruited by TdA and entered the United States illegally through Texas, spending a year in the country committing crimes until his arrest.

The illegal immigrant also confessed that the gang had been smuggling firearms into shelters by hiding them in bags for mobile food delivery companies, and even admitted to being employed by DoorDash.

The gang has been responsible for a slew of crimes across the United States following the uptick in illegal immigration under the stewardship of border czar Kamala Harris.

In May, federal authorities busted a TdA sex trafficking ring in Louisiana. Prosecutors alleged that victims were trained on how to enter the country by pretending to be asylum seekers.

The murder of 22-year-old college student Laken Riley in Georgia made headlines after it was revealed that the prime suspect was an illegal immigrant with ties to the gang.

In the wake of the memo’s release, GOP presidential nominee Donald Trump’s campaign released a statement and pinned the blame on Harris.

“Border Czar Kamala Harris is a disgrace who has surrendered complete and total control of the southern border to cartels and terrorists,” said the statement.

“Kamala is dangerously liberal and is intentionally importing millions of illegals in hopes of turning them into Democrat voters, and she doesn’t give a damn about how many Americans are hurt or killed in the process.”
