Lawsuit: Tesla Favors H-1B Visa Employees over Americans

(José Niño, Headline USA) Tesla, the electric vehicle giant led by CEO Elon Musk, is facing a class-action lawsuit accusing the company of discriminating against U.S. citizens in its hiring and employment practices. ​ 

The lawsuit, filed on Sept. 12 in the United States District Court for the Northern District of California, claims Tesla systematically favors foreign workers on H-1B visas over American citizens, allegedly paying visa-dependent employees less and terminating U.S. citizens at disproportionate rates. ​

The plaintiffs, Scott Taub and Sofia Brander, are both U.S. citizens who say they were unfairly denied employment opportunities at Tesla because of their nationality. 

Taub, a Nevada resident with over 20 years of experience in software testing and automation, applied for multiple roles at Tesla but was either rejected or dissuaded from applying. In one instance, a recruiter for a Tesla contractor explicitly stated that a position was reserved for “H1B only,” according to the lawsuit. Taub said he was “shocked” to learn that his citizenship disqualified him from consideration. ​

Brander, a California resident and experienced human resources specialist, applied for two full-time HR positions at Tesla in 2023 and 2024. Despite meeting the qualifications and having previously worked for Tesla as a contractor, she was not interviewed or hired. ​ 

The lawsuit alleges Tesla’s preference for visa workers led to her exclusion, even though she was well-suited for the roles. ​

The plaintiffs argue that Tesla’s hiring practices violate the Civil Rights Act of 1866, which prohibits discrimination based on race or citizenship. ​They claim Tesla’s reliance on H-1B visa workers is part of a broader strategy to cut costs, as visa-dependent employees are often paid less and are less likely to challenge unfavorable working conditions. ​ 

“Visa employees require Tesla’s sponsorship to remain in the United States,” the lawsuit states, adding that this dependency makes them “less likely to speak out against undesirable working conditions.” ​

The lawsuit also highlights Tesla’s growing reliance on H-1B visas. ​ From 2018 to 2024, Tesla secured over 5,400 H-1B visas, ranking 16th among U.S. companies in 2024 for new visa approvals. ​ That same year, Tesla laid off more than 6,000 workers, most of whom were U.S. citizens, while hiring over 1,350 new H-1B visa employees. ​ 

The plaintiffs allege these layoffs were part of a deliberate effort to replace American workers with cheaper, visa-dependent labor. ​

Elon Musk has defended Tesla’s use of the H-1B visa program. ​ In a December 2024 post on X, formerly known as Twitter, Musk responded to criticism of the program, saying, “We hire the best talent from around the world. ​ That’s what makes Tesla great.”

The stakes in this case are significant. ​ If the plaintiffs succeed, Tesla could face substantial financial penalties and be forced to overhaul its hiring practices. ​ The lawsuit seeks damages for affected workers, changes to Tesla’s employment policies, and a court order to end what the plaintiffs describe as Tesla’s pervasive pattern and practice of citizenship discrimination.

H-1B visas have received increasing scrutiny over the past year. As Headline USA previously reported, recent reports suggested that tech giants like OpenAI, Instacart, and Udemy may be manipulating the PERM labor certification process by directing job applicants to immigration departments instead of normal hiring channels, a practice critics argue discourages American workers and favors foreign hires. 

These allegations, which echo past DOJ cases against Facebook and Apple, come amid rising unemployment among U.S. graduates and heated debate over immigration policy.

JFK’s Grandson Could Replace Jerry Nadler

(Luis CornelioHeadline USA) Jack Schlossberg, the grandson of President John F. Kennedy, could replace retiring Rep. Jerry Nadler, D-N.Y., ahead of the 2026 Democratic primary.

The New York Post reported Monday that Schlossberg has “a shot” at winning the primary. He told his social media followers he had launched an exploratory committee to examine potential pathways to victory.

Despite launching the committee, Schlossberg has few accomplishments beyond going viral for attacking President Donald Trump.

Schlossberg, 32, is the son of Caroline Kennedy — the daughter of the late president — and businessman Edwin Schlossberg.

Despite his perceived prestigious lineage, Schlossberg has become better known for his bizarre online antics.

In January, he called himself a “literal pervert” after calling his grandmother, the late former First Lady Jackie Kennedy “hot.”

He has impersonated former First Lady Melania Trump, repeatedly attacked his cousin and current HHS Secretary Robert F. Kennedy Jr., and at one point mocked Kennedy’s battle with spasmodic dysphonia.

His behavior hasn’t been confined to family feuds. When Disney briefly pulled Jimmy Kimmel Live! off the air, Schlossberg lashed out on social media, demanding Democrats “come up with something quickly.”

“If we don’t do that and we let another election cycle go by without giving anyone anything to cheer for, we’re going to keep losing,” Schlossberg said. “We’re running out of time.”

It seems that Schlossberg is trying to bid farewell to his social media tirades and land a job—in Congress.

Nadler announced earlier this month that he would not seek an 18th term in 2026, marking the end of a political career that began in 1992.

“Watching the Biden thing really said something about the necessity for generational change in the party, and I think I want to respect that,” Nadler said in an interview with the New York Times.

Nadler endorsed close ally and Manhattan Assemblyman Micah Lasher as his preferred successor, though his endorsement could carry little influence.

Democrat Sen.’s Kids Allegedly Drove Gay Nanny to Suicide w/ Slurs, Sexual Innuendo

(Ben Sellers, Headline USA) Sen. Ron Wyden, D-Ore., has put himself front and center in recent calls for the Justice Department to investigate deceased pedophile financier Jeffrey Epstein.

While the Epstein issue has conservatives split over whether to fall in line with President Donald Trump or demand more transparency and accountability, Wyden has been consistent in his desire to press the issue, overseeing an investigation that began in 2022.

But he may now have a scandal of his own to reckon with, potentially undermining his moral authority to seek justice for Epstein’s victims.

A new lawsuit alleges that Wyden’s children drove his wife’s personal assistant—and their de-facto nanny—to suicide by tormenting him with sexual innuendo and derogatory remarks about his sexuality, then suing him for $650,000, the New York Post reported.

The suit was filed by Thomas Maltezos, the legal husband of Brandon O’Brien, who alleged in the Sept. 12 summons filed against Nancy Bass Wyden in the New York Supreme Court that two young children terrorized O’Brien while he was employed by Mrs. Wyden from June 2022 to September 2024.

The Wydens’ 10-year-old daughter allegedly exposed herself to O’Brien, made sexually explicit comments and asked invasive questions about his sex life.

A teenage son allegedly referred to O’Brien by pejorative anti-gay terms including “faggot” and “zest kitten.” The boy also threw things at O’Brien and said his football team “would rape him,” according to the suit.

At one point, Bass Wyden “maced her son to restrain him but inadvertently maced Mr. O’Brien,” the suit said.

A day after O’Brien quit, on Sept. 30, 2024, Bass Wyden filed a report with the New York Police Department that accused O’Brien of theft and credit card charges of $650,000. She also hired a private investigator and set about trashing his reputation, the suit alleged.

“The allegations against the senator’s wife are shocking, disturbing, and cruel—no person should ever be subject to this level of harassment, much less in the workplace,” Maltzeos’s lawyers said in a statement.

A distraught O’Brien committed suicide on May 26, 2025, at the age of 35.

“Brandon worked as an executive assistant and made every space better with his quiet grace and unwavering loyalty,” Maltezos wrote in an online post announcing his death. “I am completely heartbroken without him.”

Bass Wyden, whose family owns the landmark Strand Bookstore in New York City’s East Village, is seeking to have the suit tossed, according to court documents.

A statement released through her real estate company called it “baseless and deeply misguided” and “riddled with false accusations.”

It accused Maltezos of using the suit as an effort to “deflect attention” from his dead husband’s misconduct.

Ron Wyden, who became a senator in 1996 after 15 years in the House of Representatives, married Bass Wyden—his second wife—in 2005. In addition to the couple’s three kids, he has two adult children from his first marriage.

He has sided on occasion with libertarian-leaning lawmakers, not only in his advocacy of an Epstein investigation, but also regularly pushing back on government spying on citizens.

However, on other issues he has proven to be one of the farthest left lawmakers, fighting back against the Trump administration’s efforts to reduce crime and illegal immigration.

Ratings indicate that he has increasingly skewed leftward over time, voting with conservatives 0% of the time in 2022.

He has regularly touted himself as an ally to those in the LGBT community, condemning the “bigotry, hate, and violence” against them in recent legislation to force sanctions on governments that commit human-rights violations.

“We can’t let oppressive regimes get away with jailing or murdering individuals simply because of who they love and how they identify,” he continued. “This bill sends a clear message to bad actors overseas: there is no place for violence and discrimination against the LGBTQI+ community.”

Wyden also joined other 11 other Democrats in a video addressed to suicidal gay youths, telling them, “when you feel that Justice is far away, you’re going to have some very powerful friends in the United States to stand up for you.”

Obamas Partied on Superyacht While Nation Grieved Kirk’s Death

(Luis CornelioHeadline USA) As millions of Americans mourned slain conservative activist Charlie Kirk on Sunday, former President Barack Obama partied on a $250 million luxury yacht in Italy with Hollywood filmmaker Steven Spielberg.

Obama and former First Lady Michelle Obama were spotted aboard the opulent 357-foot Seven Seas over the weekend — accompanied by Secret Service, agents from Italy’s DIGOS intelligence agency and diplomatic vehicles, according to the New York Post.

Michelle was reportedly greeted by Spielberg, a multimillionaire filmmaker, on Friday afternoon, while Obama arrived Saturday evening. The couple was later seen again on Sunday night on the yacht.

Hours earlier, they had enjoyed breakfast on board before heading to lunch at Punta Chiappa, on the western Portofino peninsula.

The lavish getaway overlapped with one of the most somber moments in modern politics: Kirk’s memorial at State Farm Arena on Sunday.

The massive service drew President Donald Trump, Vice President JD Vance, Secretary of State Marco Rubio and other cabinet officials, who delivered emotional remarks to pay their respects to Kirk.

Likewise, Kirk’s widow, Erika, delivered a powerful address honoring her husband’s legacy.

Kirk, one of the most influential Republican activists, was murdered on Sept. 10 while speaking before a packed Turning Point USA crowd at Utah Valley University.

The suspect, Tyler Robinson, allegedly confessed to shooting Kirk because of his “hatred,” apparently tied to Kirk’s political beliefs.

Obama issued a perfunctory tweet the day of the murder but later accused Trump of sowing division and embracing inflammatory rhetoric during his presidency.

Would-be Trump Assassin’s Defense Begins, Ends in 1 Day; Closing Arguments Next

(The Center Square) Ryan Routh’s defense against charges of trying to assassinate Donald Trump during the 2024 presidential election campaign opened and closed on Monday with just three testimonies.

The North Carolinian and prosecutors on Tuesday will be set for closing arguments. Jury deliberations follow in the case before Judge Aileen Cannon in the U.S. District Court for the Southern District of Florida in Fort Pierce.

Routh opted not to testify. He earlier had decided not to call his son as a witness.

He did call Michael McClay, an expert on firearms. His answers, however, were seldom the way Routh thought they were going to go.

Two associates from his native Greensboro also took the stand. Marshall Hinshaw and Atwell Maison got questions and gave answers that sought to show Routh’s gentler side, one less combative than a would-be assassin as the prosecution presented in the first seven days of testimony.

Charges against Routh are attempted assassination of a major presidential candidate; possessing a firearm in furtherance of a crime of violence; assaulting a federal officer; felon in possession of a firearm and ammunition; and possession of a firearm with an obliterated serial number.

Routh has pleaded not guilty to all charges. He could face life in prison if convicted.

A construction worker by trade and having lived for a time in Hawaii, Routh in July convinced Cannon to allow him to represent himself. His lack of litigation training, however, has been evident in failing to stop the prosecution’s roll through its case either with objections or effective cross-examination; struggles to stay relevant, often drawing the ire of Cannon; and finally, less than a day of defense with a mere trio of voices on the stand compared to the prosecution’s 38.

Prosecutors say the suspect was going to attempt take the life of Donald Trump, eventual winner of the presidency over then-Vice President Kamala Harris, as he golfed on a Sunday afternoon. The Sept. 15, 2024, incident came 65 days after a shooter on a roof struck Trump’s ear with a bullet in Butler, Pa.

Security agents for Trump encountered Routh prior to the golf group reaching the area. Routh is accused of raising a rifle, leading to a shot from agents, a short vehicle chase and the suspect’s apprehension on Interstate 95.

The Center Square confirmed he participated in the Super Tuesday primaries in 2024 from the North Carolina State Board of Elections website, and in Hawaii’s 2024 elections through the Office of the City Clerk for the city and county of Honolulu.

Trump Issues Order Designating Antifa a Terror Organization

(The Center Square) President Donald Trump officially designated Antifa a domestic terror organization Monday evening, allowing the federal government to “utilize all applicable authorities to investigate, disrupt, and dismantle any and all illegal operations.”

The designation comes exactly one week after The Center Square asked the president if he would designate the group following a spat of left-wing violence, including the assassination of conservative activist Charlie Kirk.

“I would do that 100% and others also, by the way, but Antifa, is terrible,” the president responded to The Center Square during an Oval Office event.

In the official designation, the White House describes Antifa as a “militarist, anarchist enterprise that explicitly calls for the overthrow of the United States Government, law enforcement authorities, and our system of law.” The designation added that Antifa uses “illegal means” to carry out “violence and terrorism nationwide” to achieve its goals.

The White House cited “coordinate efforts” to “obstruct” federal law enforcement, specifically immigration enforcement operations through “organized riots” and “violent assaults,” including doxing, which has led to many immigration officials masking their faces as protection.

“Antifa recruits, trains, and radicalizes young Americans to engage in this violence and suppression of political activity, then employs elaborate means and mechanisms to shield the identities of its operatives, conceal its funding sources and operations in an effort to frustrate law enforcement, and recruit additional members,” according to the official designation.

“Individuals associated with and acting on behalf of Antifa further coordinate with other organizations and entities for the purpose of spreading, fomenting, and advancing political violence and suppressing lawful political speech.  This organized effort designed to achieve policy objectives by coercion and intimidation is domestic terrorism.”

The designation will allow law enforcement to utilize federal resources to investigate and “dismantle” “terrorist actions” attributed to the group or anyone “claiming to act on behalf” of the group. In addition, it will allow the federal government to investigate and prosecute those responsible for funding.

In a fact sheet released by the White House shortly after the designation, it listed several acts of violence attributed to Antifa, including a July ambush on an ICE facility in Alvarado, Texas, resulting in one officer being shot in the neck.

In May 2020, the Department of Justice “formally labeled Antifa violence as domestic terrorism.”

‘‘The violence instigated and carried out by Antifa and other similar groups in connection with the rioting is domestic terrorism and will be treated accordingly,” according to a DOJ statement.

During the event in the Oval Office on Sept. 15, the president said he would consider designating other groups, but wouldn’t indicate others by name. He said he’s talked with Attorney General Pam Bondi about bringing federal RICO (Racketeer Influenced and Corrupt Organizations Act) charges against some of these organizations and their donors.

Charlotte Train Stabber Ordered to a Mental Hospital

(Ken Silva, Headline USA) The man who stabbed 23-year-old Ukrainian refugee Iryna Zarutska to death on a Charlotte train last month remains in a county jail for now, but a judge has ordered him to be transported to a nearby psych hospital to see if he’s fit to stand trial.

Judge Roy Wiggins initially signed an order on Aug. 29 to send the alleged stabber, DeCarlos Brown Jr., to Central Regional Hospital – Butner Campus for 60 days to “determine the defendant’s capacity to proceed.” However, Brown was never transferred to the hospital.

Days after the judge’s order, the story of his horrendous crime went viral. Local media published partial footage of the gruesome footage, and Headline USA was the first to obtain the full video days later. On the same day this publication published the full video, the Justice Department announced federal charges against Brown.

As all that transpired, Brown remained incarcerated in Mecklenburg County Detention Center. On Thursday, Judge William Stetzer again ordered him to be sent to the Central Regional Hospital for a mental evaluation again.

Apparently, there had been two orders for Brown to undergo a mental exam—an order of a “local forensic capacity exam” and the other for him to be sent to Central Regional Hospital. Judge Stetzer specified on Thursday that the one to send him to Central Regional takes priority.

“The existing Order for a Forensic Examination of the Defendant for Capacity to proceed (to be conducted at Central Regional Hospital) shall make moot any previous orders for Local Forensic examination,” Judge Stetzer said. “The Order for the Central Regional Forensic Exam otherwise remain[s] in effect and unchanged.”

Brown was still at the county jail as of Monday, Mecklenburg County Detention Center public information manager Bradley Smith told this publication in an email.

Headline USA understands that Brown would still likely be incarcerated for the rest of his life, even if he were to be ruled incompetent to stand trial. He also might still face federal charges.

According to local reports, Brown, 34, has a slew of convictions for armed robbery, felony larceny, breaking and entering, and other offenses. His most recent arrest before the stabbing occurred in January, when he called 911 to complain that he had a chip in his brain. Brown, who is reporetedly schizophrenic, was charged with misusing 911.

Meanwhile, Zarutska’s family is mourning her loss. A GoFundMe purportedly established by her family says she “recently arrived in the United States, seeking safety from the war and hoping for a new beginning.”

US War Department Considers Using Charlie Kirk’s Assassination for Military Recruitment Campaign

(Dave DeCamp, Antiwar.com) Officials at the US War Department are considering using the assassination of conservative political activist Charlie Kirk as a tool for a new military recruiting campaign, NBC News has reported.

The report said that officials are considering using chapters of Turning Point USA, a political organization founded by Kirk, as recruitment centers. Possible slogans for the effort that officials have discussed include “Charlie has awakened a generation of warriors.”

Some officials are resistant to the idea, warning that a recruitment campaign could be seen as the Pentagon capitalizing on Kirk’s death. Kirk, who was only 31 years old when he was murdered, never served in the military.

When asked about the potential recruiting campaign, Pentagon spokesman Sean Parnell appeared to deny it. He told NBC: “The media is so desperate to attack this administration’s success that they are now inventing lies about our recruitment efforts. Leadership matters, and under the strong leadership of President Trump and Secretary Hegseth men and women are coming out in droves to serve this great nation.”

On Saturday, Secretary of War Pete Hegseth posted a video on X of himself reciting the Lord’s Prayer, which he said was “for Charlie,” accompanied by a montage of scenes demonstrating US military power, including missiles being fired, naval warships, fighter jets, bombers, and US troops in action.

Hegseth’s post drew criticism from some Christians for blending the prayer with militarism. “Pairing the Lord’s Prayer with military propaganda = shameful and gross,” Joshua Charles, a former White House speech writer and founder of the Catholic organization Eternal Christendom, wrote on X.

Netanyahu Fumes as UK, Canada, Australia, and Portugal Announce Recognition of Palestinian State

(Dave DeCamp, Antiwar.com) The UK, Australia, Canada, and Portugal all announced on Sunday their formal recognition of a Palestinian state, a step that comes a day before the opening of the UN General Assembly in New York.

“Today, to revive the hope of peace for the Palestinians and Israelis, and a two-state solution, the United Kingdom formally recognises the State of Palestine,” British Prime Minister Keir Starmer said in a post on X.

In response to the announcements, Israeli Prime Minister Benjamin Netanyahu vowed that there would never be a Palestinian state and bragged about his work over the years to prevent one.

“It’s not going to happen. There will be no Palestinian state to the west of the Jordan River,” Netanyahu said. “For years, I have prevented the creation of that terror state, against tremendous pressure, both domestic and from abroad.

The Israeli leader also said Israel would continue expanding Jewish settlements in the Israeli-occupied West Bank. “Moreover, we have doubled the Jewish settlement in Judea and Samaria, and we will continue on this path,” he said.

The Trump administration has discouraged its allies from recognizing a Palestinian state and has banned Palestinian Authority officials from attending the General Assembly. Trump has previously threatened a trade deal with Canada over its plans to recognize Palestine.

Netanyahu said that he will announce his response to the Western countries recognizing Palestine after he returns from the US. The Israeli leader will attend the General Assembly in New York and is expected to travel to Washington for his fourth White House visit of the year.

Netanyahu and his government are considering annexing parts of the West Bank, and some Israeli officials called for the Israeli prime minister to take the step after the UK’s announcement.

“The days when Britain and other countries determined our future are over, the mandate has ended, and the only response to the anti-Israeli move is sovereignty over the homeland of the Jewish people in Judea and Samaria, and the removal of the foolish idea of a Palestinian state from the agenda forever,” Israeli Finance Minister Bezalel Smotrich wrote on X. “Mr. Prime Minister, this is the time, and it is in your hands.”

US Ambassador to Israel Mike Huckabee has also made clear that the Trump administration wouldn’t oppose Israel if it moved to officially annex territory in the West Bank. “The US has never asked Israel to not apply sovereignty,” Huckabee told Israeli media earlier this week. “I have repeatedly stated that the US respects Israel as a sovereign nation and will not tell Israel what to do.”

Trump Taps New Federal Prosecutor to Target NYC AG James

(Chris Wade, The Center Square)  President Donald Trump has tapped a new federal prosecutor in Virginia to go after New York Attorney General Letitia James over mortgage fraud allegations.

Trump announced Saturday that he will be nominating Lindsey Halligan, a White House aide, as the top federal prosecutor for the Eastern District of Virginia. This move follows Friday’s resignation of Erik Siebert, who was allegedly pressured to file charges against the New York Democrat as part of a federal mortgage fraud investigation. 

In a social media post announcing her nomination, Trump said Halligan will be “Fair, Smart, and will provide, desperately needed, JUSTICE FOR ALL!”

“Lindsey is a tough, smart, and loyal attorney, who has worked with me for a long time, including in the winning fight against the Weaponization of our Justice System by Crooked Joe Biden and the Radical Left Democrats, which she witnessed firsthand when she stood up for my rights during the Unconstitutional and UnAmerican raid on my home, Mar-a-Lago, in Palm Beach, Florida,” Trump wrote on Truth Social. 

Halligan is one of several attorneys who represented Trump after the FBI’s raid on Mar-a-Lago over allegations that he illegally kept classified documents in a storage room at the golf club resort. More recently, she spearheaded the White House’s effort to remove “anti-American ideology” from Smithsonian Institute’s museums in the U.S. Capitol. 

Siebert resigned Friday following reports that he was pressured to file formal charges against James, a frequent Trump critic who has been accused by the administration of falsifying documents on a mortgage application to get more favorable terms. Conservative lawyer Mary “Maggie” Cleary was tapped as acting U.S. attorney for the Virginia prosecutors office. 

In an email to his colleagues Friday, Siebert said he submitted his resignation but the president took to social media to dispute the claim: “He didn’t quit, I fired him!” Trump wrote. “Next time let him go in as a Democrat, not a Republican.”

James, who was first elected in 2018, has been a frequent critic of Trump and has filed several multistate lawsuits against the Trump administration over federal immigration policies, rollbacks in federal funding, and worker layoffs and other actions. 

That includes a civil fraud trial that ended in a $454 million judgment against the Trump organization and several of its executives, which was recently overturned by a New York appeals court. James plans to appeal the decision. 

In April, the Federal Housing Finance Agency sent a letter to the DOJ accusing James of committing fraud by listing a home in Virginia as her primary residence and identifying her father as her husband on federally backed mortgage loan applications to get a lower interest rate and more favorable terms.

James’ lawyers have denied any wrongdoing and blasted the Trump administration’s investigation as political retribution.

“Firing people until he finds someone who will bend the law to carry out his revenge has been the President’s pattern — and it’s illegal,” James’ attorney Abbe Lowell said in a Friday statement. “Punishing this prosecutor, a Trump appointee, for doing his job sends a clear and chilling message that anyone who dares uphold the law over politics will face the same fate.”
