SCOTUS Rules Against Illegals’ Rights to Bond Hearings

ACLU claimed plaintiff was 'tortured by gang members because of his sexual orientation...'

(Ezekiel Loseke, Headline USA) The US Supreme Court ruled Monday that detained illegal aliens do not have the right to a bond hearing, according to the Daily Caller.

Conservative Supreme Court Justice Samuel Alito delivered the court’s opinion in the case Graland v. Aleman Gonzales.

Alito was joined in the decision by conservative powerhouse Clarence Thomas and the three Trump appointees: justices Amy Coney Barrett, Brett Kavanaugh and Neil Gorsuch.

Leftist Justice Sonia Sotomayor filed a partially dissenting opinion, which was joined by the other two leftist justices.

The case was a combination of two previous court cases.

Two illegal immigrants from Mexico brought one case. An illegal from El Salvador, who has been deported before, brought the other court case.

The plaintiffs alleged that they had a right to a bond hearing after being detained for six months, despite having no legal right to be in America.

The 9th Circuit Court of Appeals, in a split decision, ruled in favor of the illegals. However, SCOTUS reversed the decision.

The Trump administration initially brought the case forward, but, surprisingly, the Biden administration maintained the case, perhaps holding out hope for a favorable verdict to support its open-borders policies.

Not surprisingly, the far-left American Civil Liberties Union sided with the illegal immigrants.

The ACLU told MSNBC News that the Biden administration was “decidedly on the wrong side of this fight.”

In her dissenting opinion, Sotomayor emphasized the danger presented to the illegals. She wrote that the illegals sought legal protection “based on their fear that, if returned to their countries of origin, they would face persecution or torture.”

The ACLU likewise asserted that one of the illegals was in danger. It told MSNBC that he was a homosexual who had been “tortured by gang members because of his sexual orientation.”
