Justice Dept. Sues State of Idaho for Abortion Ban

(Molly Bruns, Headline USA) The Justice Department is suing the state of Idaho over the state’s law greatly restricting abortion—the first of many such lawsuits that will be coming out of the Biden administration in an effort to defy the Supreme Court‘s recent ruling that overturned Roe v. Wade.

The department argued that Idaho’s abortion law is in violation of the federal Emergency Medical Treatment and Labor Act, which requires the termination of a pregnancy if a woman’s life is in danger. The law was passed in 2020 and is set to go into effect in August.

The Idaho law allows for exceptions for rape or incest that has been reported to the police prior to the abortion. The state also decided to not prosecute physicians who perform abortions in “good faith medical judgement” to save the life of a woman.

The federal government calls this law a “near total ban” on abortions.

“We will use every tool at our disposal to ensure that pregnant women get the medical care that they are entitled to,” said Attorney General Merrick Garland in announcing the suit.

“Even in dire situations that might qualify for the Idaho law’s limited ‘necessary to prevent the death of the pregnant woman’ affirmative defense, some providers could withhold care based on a well-founded fear of criminal prosecution,” federal lawyers argued.

It is unclear why the federal government is getting involved in what is now an issue that is relegated to state-level legislatures.

“Our nation’s highest court returned the issue of abortion to the states to regulate – end of story,” Idaho Republican Gov. Brad Little said in a statement.

“The U.S. Justice Department’s interference with Idaho’s pro-life law is another example of Biden overreaching yet again while he continues to ignore issues that really should demand his attention – like crushing inflation and the open border with Mexico.”

Twitter users were quick to point how how fast the DOJ reacted to the overturn of Roe v. Wade, while continuing to ignore many serious crimes.
