(Ken Silva, Headline USA) Soon after the Biden administration took power in 2021, biological male inmate Peter Langan sued the Bureau of Prisons for a taxpayer-funded sex change—arguing that a lack of “gender confirmation surgery” violated the Eighth Amendment right against cruel and unusual punishment.
Rather than fighting the lawsuit, the BOP caved to the inmate’s demands. In January, the trans inmate—a former neo-Nazi bank robber who answers to first name Donna—received a vaginoplasty and breast augmentation surgery.
Remarkably, Langan didn’t drop the lawsuit even after receiving a sex change. Instead, the inmate further pushed for the BOP to provide free facial hair removal surgery.
Then, Langan and the BOP suddenly settled the lawsuit in June, and the BOP has refused to answer Headline USA’s queries about the matter.
During a congressional oversight hearing on Tuesday, Rep. Troy Nehls, R-Texas, pressed BOP Director Colette Peters about the absurd situation.

Nehls began by recounting how the Biden administration reversed Trump-era policies, which required the BOP to use biological sex as the initial determinant as to where inmates should be housed. He asked Peters about the implications of this reversal.
“I’m going to prison, and now instead of saying, ‘My name is Troy Nehls,’ I’m going to say, ‘My name is Susie Nehls,’ and I am a woman. And I just make that claim. At what point in time during that spectrum will that allow me then to ‘release the bull into the pen of heifers’?” Nehls asked.
Peters responded that all but 11 inmates are currently in jails based on their biological sex, and that inmates must undergo a “complex, serious evaluation from degreed medical doctors and psychologists” before they can be placed in a female prison.
Peters also said that two inmates have received taxpayer-funded sex changes. But Nehls noted that those two inmates are likely the first of many.
Nehls then asked about Langan.
“Look at this guy. This is an interesting guy, folks. His name is Peter Langan … He looks like a bad, bad guy. He is a bad, bad guy. He’s an ex-Nazi terrorist. He’s a bad, bad hombre. And this guy wants to be referred to as Donna,” the congressman stated, displaying a Headline USA article about Langan.
“He’s claiming his Eighth Amendment rights were violated for not being provided gender-confirming surgery. For the people at home: This person is an ex-Nazi bank robber. In June, his lawsuit was settled. And I’d like to know whether this means that inmates now have the Eighth Amendment right to sex changes. Are we paying for guys like this, who are just sick?” Nehls asked.
Nehls pointed out the obvious: that Langan’s lawsuit might have paved the way for countless inmates to exploit the system.
“If I’m going to prison for 10 years, I guess I would want to go to prison where the ladies are. Wouldn’t that be a good idea? And if you’re allowing that to take place through this process by talking to these shrinks and these guys, I’m going to convince you I’m a woman,” he said.
“And I’m going to enjoy five years in prison. In fact, half of the guys will probably say, ‘Don’t even release me! I’m having too much fun.’”
