Biden Vax Mandate Slapped w/ More Injunctions, One Nationwide

'During a pandemic such as this one, it is even more important to safeguard the separation of powers set forth in our Constitution to avoid erosion of our liberties...'

President Joe Biden’s tyrannical vaccine mandate has been whacked by dual serious blows, further exemplifying the gross overreach of the White House edict.

A Louisiana U.S. district judge blocked a federal COVID-19 vaccine mandate for health care workers Tuesday, reported The Daily Advertiser, issuing a nationwide injunction against Biden’s effort to require wide segments of the population to be vaccinated.

The ruling came on the heels of a preliminary injunction issued previously in the day by a federal judge in Kentucky, which applied to federal contractors and subcontractors in Kentucky, Ohio and Tennessee, reported the Lexington Herald Leader.

That ruling came in response to a challenge from Kentucky Attorney General Daniel Cameron, who joined many other state attorneys general in challenging the mandate.

“This is not a case about whether vaccines are effective. They are,” U.S. District Judge Gregory Van Tatenhove wrote. “Nor is this a case about whether the government, at some level, and in some circumstances, can require citizens to obtain vaccines. It can.

“The question presented here is narrow,” he said. “Can the president use congressionally delegated authority to manage the federal procurement of goods and services to impose vaccines on the employees of federal contractors and subcontractors? In all likelihood, the answer to that question is no.”

That opinion was shared and taken a step further later in the day by Louisiana Western District U.S. Judge Terry Doughty.

Doughty ruled on the lawsuit led by Republican Louisiana Attorney General Jeff Landry and joined by 13 other states, reported the Daily Advertiser, but Doughty added a nationwide injunction in his ruling.

“If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands,” Doughty wrote. “If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.

“During a pandemic such as this one,” he added, “it is even more important to safeguard the separation of powers set forth in our Constitution to avoid erosion of our liberties.”

Louisiana AG Landry agreed with the judge’s logic.

“While Joe Biden villainizes our healthcare heroes with his ‘jab or job’ edicts, I will continue to stand up to the president’s bully tactics and fight for liberty,” Landry said.

“While our fight is far from over,” he continued, “I am pleased the court granted preliminary relief against the president’s unconstitutional and immoral attack on not only our healthcare workers but also the access to healthcare services for our poor and elderly.”
