(Mark Pellin, Headline USA) U.S. District Judge Tim Kelly continued his reign of terror in sentencing J6 patriots when he slapped an Infowars host to 60 days in jail for exercising his First Amendment rights.
Despite not entering the Capitol when a largely peaceful protest devolved into a short-lived riot, Kelly on Tuesday sentenced Owen Shroyer to two months in jail for addressing the crowd of protestors outside the Capitol. Shroyer was not accused of committing any violence or destroying any property on Capitol grounds.
Kelly similarly sentenced Proud Boys former leader Enrique Tarrio to 22 years behind bars, despite Tarrio being absent from the Capitol on Jan. 6.
Shroyer’s grievous crime that drew a 60-day jail term was allegedly speaking too loudly to the J6 crowd, including one would assume infamous fedsurrection instigator Ray Epps, despite Shroyer warning protesters to not enter the Capitol because it was a fed set-up.

Prosecutors from Biden’s DOJ piggybacked on a deferred prosecution agreement that Shroyer had signed in 2019 after he was charged for shouting during a protest of a House Judiciary Committee impeachment hearing. As part of the deal Shroyer had agreed not to utter “loud, threatening, or abusive language, or to engage in any disorderly or disruptive conduct, at any place upon the United States Capitol Grounds.”
Shroyer’s comments over a loudspeaker on Jan. 6 violated that agreement, with Biden prosecutors initially seeking a 120-day prison term for a citizen exercising his First Amendment rights, which they argued didn’t apply in the case.
“Democrats are posing as communists, but we know what they really are: they’re just tyrants, they’re tyrants,” Shroyer said on a bullhorn during the tumultuous events, NBC News reported. “And so today, on January 6, we declare death to tyranny! Death to tyrants!”
Prosecutors claimed Shroyer’s inflammatory rhetoric inspired some of the more riotous protesters, even though he never entered the building and warned the MAGA faithful to not fall prey to a Fred trap by entering the Capitol.

“By the time this case is fully litigated, well, let’s just say it might become one of the biggest free speech cases in the history of the United State of America,” Shroyer said Tuesday.
Citing cases of violent insurrectionists who recently stormed House Speaker Kevin McCarthy’s office, as well as multiple examples of threatening protests during confirmation hearings for conservative Supreme Court justices, Shroyer slammed the two-tiered injustice system.
“If I had been a leftist, Democrat liberal progressive and I rioted during Trump’s inauguration or I rioted during any of the years Donald Trump was in office, whether it was the Summer of Rage in 2020 with the Black Lives Matter riots, or any of the events during the Antifa riots, I would not be here today,” Shroyer said.
“I would not be facing jail time. And all this would have been washed away in the legal system, if it would have even made it the far.” he said.
Backlash to the 60-day prison sentence leveled by Kelly echoed that sentiment, and many commentators warned of the dire implications of the double-standard.
“The Biden regime is making it clear: ‘Challenge us in any way and we will throw you in prison,'” tweeted Trending Politics’ Collin Rugg. “Basically, he is going to prison for exercising his 1st Amendment rights. Despicable.”
Owen Shroyer didn’t go into the Capitol.
He didn’t break any laws.
He had previously been arrested for peacefully and silently standing inside a building. Which Democrats do DAILY.
DOJ said he violated his agreement by marching on January 6th.
He is a political prisoner.
