New York Proposes Criminalizing Videos of Violent Crime

(Headline USA) Taking a break from her relentless Trump witch hunt and coddling criminals with leftist so-called justice reforms, New York Democrat Attorney General Letitia James proposed criminalizing the sharing of violent crime footage and called on Big Tech to do more to censor videos and other posts about criminal acts.

James’s proposal, which started as a task from New York Democrat Gov. Kathy Hochul, would introduce new civil liability for distributing such content, including footage produced by mass shooters and other criminals, with “sufficient exemptions” for “content with social, educational, or historical value,” according to Reclaim the Net.

Under the proposal, social media platforms that fail to “take reasonable steps to prevent unlawful violent criminal content,” as defined by the regime, could also be held liable under Section 230 of the federal Communications Decency Act.

“The drafters of Section 230 wanted to encourage content moderation by providing protections to online platforms acting as ‘Good Samaritans’ in their attempts to monitor and remove offensive content on their platforms,” the report reads.

“However, the internet has changed dramatically since 1996, and in that time, courts have found that Section 230(c)(1), which protects companies from liability for the under-removal of user content, ‘should be construed broadly in favor of immunity,’” the report continues.

The policy follows an investigative report into the Buffalo massacre, during which the alleged perpetrator livestreamed his violent acts on Twitch. The shooter wrote in his diary that he was inspired to film the massacre after watching similar videos, including one of the mass shooting in a mosque in Christchurch, New Zealand, online.

Referring to the Buffalo shooter, James claimed unregulated social media platforms have come “breeding grounds” for “white supremacy.”

“By his own account, the Buffalo shooter’s path towards becoming a white supremacist terrorist began with that clip,” she said.

“The anonymity offered by 4chan and platforms like it, and their refusal to moderate content in any meaningful way, ensures that these platforms continue to be breeding grounds for racist hate speech and radicalization.”
