Doctor Investigated for Failing to Report Rape of 10-Yr-Old, Subsequent Abortion

(Ezekiel Loseke, Headline USA) Todd Rokita, Indiana’s Republican attorney general, is investigating Caitlyn Bernard, the Indiana doctor who claimed to have given a 10-year-old an abortion after the girl was repeatedly raped by an illegal alien.

Rokita sent a public letter to Republican Gov. Eric Holcomb explaining his reasons for investigating Bernard, as reported by Politico.

“A physician presented with a pregnant pre-teen—a victim of sexual assault—must report the assault to enforcement immediately,” noted the letter.

“One who aborts the pregnancy of such a rape victim must within three days file a report of the abortion with both the Indiana Department of Health and the Indiana Department of Child Services,” it added.

Rokita went on to explain that the abortion reports are public documents and that his staff had requested from the Indiana Department of Health all abortion reports filed within the last 30 days, “to ensure the high-profile abortion had been filed.”

IDOH, citing a new system, informed Rokita’s office of a delay because of a new filing system on July 12. As of Thursday, the department had not produced any abortion records.

On July 12, according to the letter, Rokita’s staff also reached out “several times” to Indiana’s Department of Child Services. Still, as of the writing of the letter on Wednesday, Rokita said his office had received no response.

Rokita explained that the offense could carry legal penalties and affect her medical license.

“If Dr. Bernard has failed to file the required documents on time, she has committed an offense,” he wrote.

Rokita said he must investigate because he has an “important responsibility” to protect “the safety and well being of children and families across Indiana and even, as in this case, those from other states.”

He also reminded the governor that “we bear a similar responsibility to ensure that medical professionals abide by the law, particularly those designed to protect Children.”

This is even more important than it may appear in this case, because the rapist of the ten-year-old was an illegal alien.

Rokita had warned of just such an event in April, when he led the charge in a lawsuit asking the US Supreme Court for a full reinstatement of former President Donald Trump’s “Remain in Mexico” policy.

“[T]he situation at our southern border provides the perfect example of how going soft on the rule of law gives rise to anarchy, chaos, and ultimately the erosion of our freedom and safety,” Rokita warned.

“We are simply insisting that the Biden administration follow the law,” he added.

In response to the letter, leftists rallied around Bernard saying that she had done nothing wrong in her efforts to conceal the abortion and its circumstances from public records while allowing it, somehow, to be selectively leaked pro-abortion lawmakers.

Kathleen DeLaney, an attorney representing Bernard, threatened to take legal action against the attorney general for besmirching the abortionist’s good name, while insisting that Bernard “took every appropriate and proper action in accordance with the law and both her medical and ethical training as a physician,” the Associated Press reported.

“She followed all relevant policies, procedures, and regulations in this case, just as she does every day to provide the best possible care for her patients,” DeLaney said in a statement. “She has not violated any law, including patient privacy laws, and she has not been disciplined by her employer.”
