(Jacob Bruns, Headline USA) Republican House Minority Leader Kevin McCarthy, R-Calif., suggested last week that the Jan. 6 Committee’s attempt to subpoena him is illegitimate because the entire committee is illegitimate, Just the News reported.
McCarthy’s attorney, Elliot S. Berke, penned a letter to the House J6 Committee Chairman Bennie Thompson, D-Miss., suggesting that their recent attempt to subpoena McCarthy and other Republicans is illegal because the panel was not properly created by Congress itself.
According to Berke, if the subpoena were valid, it would be justly honored.
“All valid and lawfully issued subpoenas must be respected and honored,” Berke wrote. “Unfortunately, the words and actions of the Select Committee and its members have made it clear that it is not exercising a valid or lawful use of Congress’ subpoena power.”
He also noted that House Speaker Nancy Pelosi, D-Calif., was responsible for the failure of the committee to be formed within the bounds of the House of Representatives.
“The Speaker has failed to act in accordance with the Rules of the United States House of Representatives … she put forth, and as a result, the Select Committee has operated both in composition and manner that deviates from the duly authorized Resolution that created it,” he wrote.
Further, the J6 Committee is illegitimate because Pelosi never allowed the Republicans to choose their own representatives on the Committee. Instead, Pelosi appointed RINOs who would simply go along with the Democrats on their witch-hunt.
McCarthy, himself, is the one who ought to have made the appointments. He attempted to do so, but recalled all Republican members after Pelosi refused to allow GOP Reps. Jim Banks of Indiana and Jim Jordan of Ohio to participate
