SCOTUS: Wall Lawsuit Needs Revisiting as Biden Creates ‘Changed Circumstances’

On Monday the Supreme Court handed a defeat to President Joe Biden and his administration regarding the completion of former President Donald Trump’s border wall, the Western Journal reported.

The high court overruled lower courts, which had previous ruled that wall construction ought to be halted due to environmental concerns.

The Sierra Club, a left-wing environmentalist group, filed several lawsuits in attempts to stop the construction of the border wall.

More prominently and more successfully, the leftist American Civil Liberties Union won a lawsuit in the Northern California Circuit Court, which is notoriously activist.

The Circuit Court at the time ruled that the Trump administration could not use funds from the Pentagon to secure the border.

The Ninth Circuit agreed with the lower court on appeal.

Fortunately, the Supreme Court has halted the madness.

“The judgment [of the district court] is vacated, and the case is remanded to the United States Court of Appeals for the Ninth Circuit with instructions to direct the District Court to vacate its judgments,” the Supreme Court wrote in its ruling.

“The District Court should consider what further proceedings are necessary and appropriate in light of the changed circumstances in this case,” it added.

Last January Biden ordered the halting of construction via executive order.

“Like every nation, the United States has a right and a duty to secure its borders and protect its people against threats,” Biden said at the time. “But building a massive wall that spans the entire southern border is not a serious policy solution.”

Biden also called the border wall “a waste of money that diverts attention from genuine threats to our homeland security,” despite the disastrous border crisis that has ensued since he took office.

While border towns are overrun crime, the president has instead chosen to pursue phantom “domestic extremists,” including parents who question school boards about the teaching of Critical Race Theory in schools.
